Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Spectral Colors website and the products and licenses you buy from us. Spectral Colors is an independent studio operated by JM Roque da Silva (trading as Lux Splendore), based in the Netherlands (KVK 76428931, VAT NL003084277B70) ("we", "us", "our"). By using the site or buying a product, you agree to these Terms.

What we offer

We sell downloadable audio plugins and Windows applications with license keys, and we offer custom software and audio-production services. Products are provided as software you download and install on your own devices under a license (see below) — they are licensed to you, not sold.

Your account

You are responsible for keeping your login details secure and for activity under your account. Please give accurate information and keep your email up to date so we can deliver your licenses and receipts.

Orders, prices & payment

• Prices are shown in euros (€) and may include or exclude tax as indicated at checkout.
• Payment is processed securely by Stripe. Your purchase is confirmed once payment succeeds.
• On successful payment we issue your license key(s) and email them to you; they also appear in your account.
• We may correct obvious pricing errors and cancel affected orders with a full refund.

License to use the software

When you buy a software product, we grant you a personal, non-exclusive, non-transferable license to:

• install and use the product on devices you own or control, up to the activation limit shown for that product;
• use audio products to create your own music and audio work, commercially or non-commercially.

You may not:

• share, resell, rent, sublicense or distribute your license key or the installers;
• reverse-engineer, decompile or disassemble the software, except where the law expressly allows it;
• remove or alter any copyright or ownership notices;
• use the software to build or train a competing product.

All intellectual property in the software, artwork, and this site remains ours (or our licensors'). Your license may be suspended or revoked if you breach these Terms, or if a purchase is refunded or charged back.

Activation

Products may require a one-time online activation and occasional online re-checks to confirm the license is valid. Each license allows a set number of active devices; you can deactivate a device from your account to free up a slot for another computer.

Downloads & updates

You are responsible for downloading your products and keeping your own backups. We may release updates and improvements at our discretion, but we don't guarantee that any specific update or future version will be provided.

Acceptable use of the site

Don't misuse the site — for example by attempting to break its security, disrupt it, access other users' data, or use it for anything unlawful.

Disclaimers

Our software and site are provided on an "as is" and "as available" basis. While we work hard to make them reliable, we don't warrant that they will be uninterrupted or completely error-free, or that they will work with every host or system. Always save and back up your work.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential losses, or for lost data or lost profits arising from your use of our products or site. Nothing in these Terms limits liability that cannot be limited by law, and nothing affects your mandatory statutory rights as a consumer.

Your consumer rights

If you are a consumer in the EU/EEA, you have statutory rights under applicable consumer law that these Terms do not override.

Changes to these Terms

We may update these Terms from time to time; the "last updated" date at the top will change. Continued use of the site or products after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Netherlands. If you are a consumer, you also benefit from any mandatory consumer-protection rules of the country you live in.
